Terms of Service

1. Acceptance of Terms

By accessing or using SunnahSpouse, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the application. SunnahSpouse is operated in accordance with the laws of Australia and applicable international digital standards.

2. Strict 18+ Eligibility & Minimum Age Requirement

• Strict 18+ Policy: SunnahSpouse is strictly and exclusively restricted to adults who are at least eighteen (18) years of age. Registration, profile creation, or use of the service by anyone under 18 is strictly prohibited.
• Zero Tolerance for Child or Underage Marriage: Facilitating, promoting, soliciting, or entering any arrangement involving a minor under 18 years of age is strictly forbidden. Under the Australian Criminal Code Act 1995 (Cth) (Division 270) and international conventions, marriage of a minor is legally recognized as forced marriage. Any attempt to introduce or list an underage individual will result in immediate termination, permanent device/IP ban, and immediate referral to relevant civil and criminal law enforcement authorities.
• Age Compliance & Account Enforcement: In keeping with our data-minimization privacy principles, SunnahSpouse does not collect or store sensitive government identity documents (such as passports or driver's licenses). Eligibility relies upon strict 18+ user self-declarations and solemn guardian (Wali) legal undertakings. SunnahSpouse reserves the unconditional right to immediately suspend or permanently remove any account where reasonable suspicion of underage participation or misrepresentation arises.

3. Guardian (Wali) Role, Representation, & Legal Warranty

• Islamic and Legal Representation: Sisters' matrimonial profiles may be created, co-managed, or linked with a recognized Wali (guardian), such as a father, brother, paternal uncle, or legitimate Islamic representative.
• Guardian Statutory Attestation: Any guardian, parent, or representative who creates, registers, or oversees a profile for a sister or daughter explicitly, solemnly, and legally warrants that: (a) the candidate is at least eighteen (18) years of age; (b) the candidate has provided her free, voluntary, and informed consent to seek marriage through this platform; and (c) all information provided is accurate and truthful.
• Guardian Indemnification: Any guardian or user who misrepresents the age or identity of a candidate agrees to fully defend, indemnify, and hold harmless SunnahSpouse, its operators, directors, and officers from and against any claims, losses, liabilities, damages, costs, regulatory penalties, or legal fees arising out of such fraudulent misrepresentation.

4. Account Registration & Modesty Guidelines

• You must provide accurate and complete information during registration.
• Only one account per person is permitted.
• No inappropriate, offensive, or un-Islamic content is permitted.
• Sister photos are stored privately and NEVER displayed publicly on candidate search cards.
• Sister photos are ONLY shared via private chat when her linked Wali explicitly approves a photo request.
• Brother photos are subject to moderator review to ensure decency and modesty.

5. Wali (Guardian) Communication Workflows

• Sisters must have a legitimate Wali linked via a secure 8-digit PIN to activate their profile and receive communications.
• Walis are responsible for reviewing incoming interests and managing direct chat communications with prospective suitors.
• Walis approve or decline sister photo requests to uphold Islamic modesty guidelines.
• Walis may manage up to 5 sister profiles.

6. Subscriptions and Payments

• Monthly subscription: $14.99 USD.
• Yearly subscription: $99.00 USD (there are no quarterly subscriptions).
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing cycle.
• Manage or cancel subscriptions anytime via App Store, Google Play, or account settings.
• No refunds for partial subscription periods.

7. Free vs Premium Features

• Sisters (Always 100% Free): Full account creation, candidate browsing, sending and receiving interests. All matching communications flow through their linked Wali.
• Walis (Always 100% Free): Link to sisters via 8-digit PIN, receive notifications, approve/decline photo requests, and conduct unlimited direct chats with suitors at no charge.
• Brothers (Free - Browse Only): Create profile, browse sister profiles, and express interests. Direct chat with Walis and advanced features require upgrading to Premium.
• Brothers (Premium Membership): Upgrade to monthly ($14.99 USD) or yearly ($99.00 USD) membership to unlock direct communication with Walis, submit photo unlock requests, and access all premium features with priority visibility.

8. Prohibited Conduct & Safety Enforcement

• Strict prohibition of harassment, abuse, coercion, defamation, or inappropriate solicitations.
• Strict prohibition of falsifying identity, age, or relationship to a candidate.
• Strict prohibition of commercial solicitation, spam, or scams.
• Immediate reporting mechanism: Any member can report suspicious or suspected underage profiles directly within the platform for immediate administrative investigation.

9. Account Deletion & Automated Data Cleanup

• Users may delete their account and personal data at any time via Settings.
• Automated Cascade Cleanup: Upon voluntary account deletion or administrative removal, the system permanently purges all associated chat rooms, messages, photo requests, profile documents, uploaded media, notifications, and block records from our database.
• We reserve the right to suspend or terminate accounts for violations of these terms without prior notice.

10. Inactive and Dormant Accounts Policy (Over 1 Year)

• Classification: Accounts with no recorded activity for twelve (12) consecutive months are classified as dormant.
• Administrative Deactivation: To protect member privacy and optimize matchmaking quality, dormant accounts are deactivated.
• Permanent Data Purge: SunnahSpouse reserves the right to permanently purge records of accounts inactive for over one (1) year.

11. Disclaimer of Warranties

The application is provided 'as is' and 'as available' without warranties of any kind. We do not guarantee marital outcomes, compatibility, or the accuracy of third-party representations.

12. Limitation of Liability

To the maximum extent permitted by Australian law and applicable consumer protection statutes, SunnahSpouse shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of your use or inability to use the service.

13. Governing Law & Jurisdiction

These Terms of Service and any dispute arising out of or related to SunnahSpouse shall be governed by and construed in accordance with the laws of Australia, including the Australian Consumer Law (ACL) and the Commonwealth Criminal Code Act 1995. You submit to the exclusive jurisdiction of the competent courts of Australia.

14. Changes to Terms

We may update these terms periodically to reflect evolving legal, technological, or community standards. Continued use of the platform after modifications constitutes acceptance of the revised terms.
